Village Resident, Cody Sutton, Charged With Murder and Arson PDF Print E-mail

Cody Sutton of Mad River Township was arrested on Thursday, June 21 in connection to the fire at Dayspring Care Center located on Dayton Road, November 25 of last year.   Members of the Clark County Sheriff’s Office Criminal Investigation Division and the U S Marshall’s SOFAST Task Force arrested Sutton at his home.  
Sutton has been charged with two counts of aggravated arson and one count of murder.  A Clark County grand jury indicted Sutton on Monday in connection to the death of Dayspring resident, 89-year-old Kathleen Hart, who suffered a cardiac incident as a result of the evacuation of the facility during the emergency.  Hart was taken to Miami Valley Hospital where she later died.  Her death was ruled a homicide by the Montgomery County coroner’s office.
The Clark County Sheriff’s Office detectives and members of the Ohio State Fire Marshall’s Office determined during their investigation that the fire had been intentionally set.  Based on evidence collected at the scene and further testing, two points of origin were determined for the fire, and it was proven that the cause could not be anything except intentional.  Surveillance footage obtained from Dayspring reportedly showed Sutton in the area of a storage room just prior to the start of the fire.  According to records, Sutton was employed by Dayspring and was working at the time of the fire.  He was terminated shortly after the incident.
Sutton is a 2011 graduate of Greenon High School.  He has no prior criminal history; he was arraigned in Clark County Common Pleas Court on Friday, June 22 and entered a plea of not guilty.  According to court records, Sutton is being represented by James D.
